Thanks for visiting Loxo's Privacy Policy (“Privacy Policy” or “Policy”).

This Privacy Policy describes how Loxo Holdings, Inc. ("Loxo,” “we”) process information about you, including when you use our Services (as defined below) or if you are someone whose information is in our candidate sourcing database.

This Privacy Policy also applies when you use Loxo’s Candidate Portal, including when you create or maintain a candidate account or profile, search for jobs, choose to make your professional information available to recruiters or other Customers, submit job applications through Loxo, receive communications about potential opportunities, or otherwise interact with Loxo in connection with career opportunities.

By accessing or using the Loxo.co website, including all subpages and successor pages (collectively referred to as the "Site") as well as all software (including application programming interfaces ("APIs"), browser extensions, and integrations with third-party software) and services we offer through our Site, our Candidate Portal, or any other location where this Privacy Policy is posted, including our talent discovery, candidate sourcing, recruitment and talent intelligence services and our job search and job application services, (collectively, along with related communications features, referred to as the "Services"), you acknowledge that you have read this Privacy Policy and that you agree to the practices described in this Privacy Policy as they relate to your information.

The Services We Provide
Loxo provides various services and data-driven solutions to Customers to help improve hiring and retention, marketing, sales and other business activities, including an Applicant Tracking System (ATS); Customer Relationship Management (CRM); job board integrations which enable recruiting professionals gain access to career opportunity information; recruiting and sales automation tools that expedite communications and workflows throughout the hiring lifecycle.

Loxo also offers a Candidate Portal that allow individuals to create an account, build and maintain a professional profile, search for career opportunities, apply for jobs through Loxo, and, depending on their settings, make their professional information available to Customers and recruiters who use the Services to identify and communicate with potential candidates. When we provide the Candidate Portal and process information that individuals submit to create an account, maintain a profile, update preferences, search for jobs, or apply for jobs through Loxo, Loxo acts as a controller of that information, except where we expressly state otherwise.

As part of our Loxo Source service, we collect multiple pieces of publicly available information about individuals from a large variety of sources and make that information available to Customers to assist them in sourcing potential candidates for open roles. Please note that the use of your information by Customers is governed by their respective privacy policies.

Claim Your Loxo Professional Profile
Claim your Loxo Professional Profile to promote yourself or your Company to our customers and partners, edit or update information about you (including your contact information or employment information), and consolidate multiple profiles into a single Loxo Professional Profile for accessibility or ease of use.

You can opt out of our database at any time from this link or by contacting us using the information in the “Contact Us” section below.  If you remain in our database, you may be contacted by Customers when they are sourcing potential candidates for their open roles.

Information that We Process for Customers

Our business Customers may use Loxo to process information about you on their behalf.  In that case, Loxo processes your information at the direction of those Customers and subject to our agreements with them.  This Privacy Policy does not apply to such processing.

If your data has been submitted to us by a Loxo Customer, or where you use the Services in connection with a Customer’s subscription to the Services, and you wish to exercise any rights you may have under applicable data protection laws, please inquire with the relevant Customer directly.

This section does not apply to information that Loxo collects directly from you through the Candidate Portal for our own purposes, such as creating and maintaining your Candidate Portal account or profile, managing your profile visibility settings, enabling you to search for jobs, submitting applications through the Loxo application portal, or operating candidate matching and recommendation features. Those activities are described in this Privacy Policy.

When you apply for a job or provide information about your preferences through the Candidate Portal, Loxo may disclose your preferences, application materials and related information to the relevant Customer or recruiter. That Customer or recruiter may use your information as an independent controller for its own recruiting, hiring, compliance, and employment-related purposes, and its privacy policy applies to the processing of the information you submit to them.

1. Information We Collect

We collect information: a) directly from you, b) automatically using cookies and other similar technologies, c) using our Loxo Indexers and Browser Extensions, and d) from third parties.

1.1 Information You Provide Directly to Us. We collect information about you that you provide to us when you use the Services or otherwise interact with us through online or offline channels. For example, we collect information from you when you:

• Visit our Site;

• Register for and use the Services (including by claiming your Loxo Professional Profile or registering for an account through our Candidate Portal);

• Fill out a form on the Site or download material from us;

• Search for jobs, save jobs, express interest in jobs, or apply for jobs through Loxo’s application portal;

• Correspond with us or Customers and other recruiters through the Services or other channels, including telephone, email, a chat functionality, or otherwise, such as for customer support purposes;

• Subscribe to our mailing lists, newsletters, or other forms of marketing communications;

• Respond to or participate in surveys; or

• Attend our events or otherwise interact with us at other conferences or events.

Depending on how you interact with us, the types of information we collect directly from you may include:

• Contact information (e.g., first and last name, email address, physical mailing address, and telephone number);

• Log-in credentials for the Services;

• Employment information (e.g., your company or organization name; your job title; your start date with your current and prior employers; education history; skills; profile picture; and other information contained in a resume, CV, or cover letter that you upload or make available through the Services);

• Demographic information (e.g., on voluntary self-identification demographic forms for EEOC compliance when applicable);

• If you sign up for our Candidate Portal, information related to your interest in particular employers or jobs (e.g., jobs viewed, searched, saved, applied to, or otherwise interacted with, and your preferences related to job recommendations or communications);

• In accordance with applicable legal requirements, recordings or transcripts of sales and customer service calls with us (whether over the phone, Zoom, or another platform);

• Payment information, which is collected and processed by our third-party payment processors on our behalf;

• Any other information you choose to provide directly to us.

You may choose whether to provide certain information to us, but if you choose not to provide certain information, we may not be able to provide the Services to you or respond to your other requests. Additionally, please do not include sensitive personal information in your Candidate Portal profile, resume, CV, or application materials unless it is relevant to the role or application process and you are comfortable providing it. Where required by law, we will seek your consent or otherwise process sensitive personal information in accordance with applicable law.

1.2 Information We Collect Automatically. When you use our Services, we and our vendors automatically collect certain information about your device and how you use the Services. This information includes your IP address, browser type, browser language, operating system, device event information (such as crashes, system activity), software and hardware attributes (including device IDs), referring and exit pages and URLs, platform type, the number of clicks, search terms, files you download, domain names, landing pages, pages and features viewed and the order of those pages, the amount of time spent on particular pages, the date and time you used the Services, telephony log information (like phone numbers, types of calls, time, date and duration of calls, SMS routing information), error logs, and other similar information, and location, which we may derive from your IP address.

To collect this information, we and our vendors may use “cookies,” server logs, beacons, pixels, and other similar technologies (collectively, “Tracking Technologies”) that track, measure, and analyze the behaviors and usage patterns on our Services, including on our Site and through emails we exchange. We may also allow third parties to use Tracking Technologies on our Services. We use Tracking Technologies for a variety of purposes, including to provide and customize your online experience; to recognize you when you return to the Services, to help us understand how you and other users engage with the Services, to improve the performance, usability and effectiveness of the Services; to advertise and market our services and to measure the effectiveness of our marketing activities. You may set your web browser to notify you when you receive a cookie and to accept or refuse certain cookies. However, if you elect not to accept cookies, some functionality and areas of the Services may be impacted. To learn how to manage your cookies, please follow the instructions from your specific browser, or if accessing the Services via a mobile device, refer to the device manufacturer’s instructions.

1.3 Information we collect from third-party sources
We may also collect information about you from other sources, including third parties from whom we have purchased or licensed information, and we may combine this information with the information you provide.

1.3.1. Information relating to Customers. If you are a Customer or a potential Customer, from time to time, we may collect information about you from other sources, including our corporate affiliates, marketing vendors, survey providers, data enhancement services, data brokers, other websites and services, social media, conferences, and other industry events, to the extent permitted by applicable law.

1.3.2. Information licensed to Customers. If you are an individual (including when you claim a Loxo Professional Profile or sign up for an account and make a profile through the Candidate Portal), we may receive information about you from various sources, including from data aggregators, data brokers, other companies, social media platforms, public databases, and other commercially available sources. Such information may include your name, business contact information, including mailing address, job title, email address, phone number, and custom profiles from third party data providers. This information is made available to Customers in connection with their use of the Services.

1.4 Specific Features
1.4.1. Information from Loxo Indexers
Our proprietary indexing systems ("Loxo Indexers") collect information from a variety of sources in order to compile information about corporations, non-profits, and similar entities ("Companies") and the professionals that work for them ("Professionals").
We may collect information about you as information, and to help us compile, organize, and verify information, including in the following ways:

‍1. from publicly accessible sources, both online and offline, algorithmically through the Loxo Indexers or provided by third parties;

2. through licensing agreements directly with data brokers or other Companies that collect and disclose publicly available information, pursuant to their privacy policies and terms and conditions; and

3. directly contributed by individuals, about both Professionals and Companies, either by claiming their Loxo Professional Profile or in the form of "Crowdsourced Data", meaning information and data collected through free Services (subject to the licenses in the Loxo Terms of Service) that we may offer in connection with free browser-based add-ons, extensions, or plug-ins ("Loxo Browser Extensions").

We use information to provide the Services, for internal research and development purposes, and to maintain and improve the quality of our Services.

1.4.2. Loxo Browser Extensions
Users of the Loxo Browser Extensions can choose to make certain information and data available to the Loxo Indexers. When you install a Loxo Browser Extension, you may elect to link certain applications, such as email clients. If you do, you grant us permission to access, use, and share certain information contained therein. This information may include contacts' names, email addresses, social media handles, contacts-in-common, business phone numbers, business-related postal addresses, job titles and departments, company names, company website URLs, and IP addresses.

Candidate Portal

The Candidate Portal allows individuals to create accounts, maintain professional profiles, search for jobs, apply for jobs through Loxo, manage profile visibility settings, and communicate about career opportunities. We may process Candidate Portal information to provide these features, authenticate users, maintain profile and application records, show relevant jobs or opportunities, enable Customers and recruiters to identify potentially relevant candidates, facilitate job applications, and support candidate, recruiter, and Customer communications.

If you choose to make your Candidate Portal profile visible to recruiters or Customers, your profile information may be searchable or viewable within the Services and may be used by Customers or recruiters to evaluate whether to contact you about potential opportunities. You may be able to change your profile visibility settings in your account.

1.4.3. Candidate Matching and Automated Assistance Features
We may use automated technologies (including through the help of automated technology vendors) to help operate and improve the Candidate Portal and related recruiting features. For example, these technologies may help surface candidates whose profiles appear relevant to a role, organize search results, recommend jobs or candidates, generate summaries or insights from profile or application information, identify potentially relevant skills or experience, or help Customers and recruiters manage recruiting workflows.
These tools are intended to assist Customers and recruiters and do not make final hiring or employment decisions on behalf of Loxo or Customers. Customers and recruiters are responsible for their own recruiting, hiring, and employment decisions.

2. How We Use Your Information

We and our vendors may use your information for various purposes, depending on the context and the type of information, including to:

• Provide Customers with access to the Services;

• Enable individuals to create and maintain an account through the Candidate Portal (including as applicable, to allow individuals to submit professional-related information to complete their profiles, make their profiles visible to Customers and recruiters, and apply for jobs through the Candidate Portal);

• Recommend jobs that we think will be of interest to our users;

• Generate candidate summaries, insights, or recommendations to support recruiting workflows;

• Provide, operate, maintain, administer, and analyze our Site and Services;

• Communicate transactional information to you about the Services, respond to your requests, and provide you with more effective and efficient customer service, including via email, and postal mail;  

• Contact you by email or postal mail with updates, information, promotions, surveys or contests relating to the Services or other services that may be of interest to you, in accordance with applicable legal requirements related to such communications;  

• Engage in analysis and research regarding use of the Services, to improve our Services, and develop new Services or leads (which may involve the use or training of artificial intelligence and large language model processing technologies, in accordance with applicable law);

• Allow us and our advertising partners to create and personalize the content and advertising that you see on the Site and on third-party websites;  

• Measure the effectiveness of our advertising and deliver relevant advertising to you;  

• Secure our Services and address technical issues;  

• Comply with applicable laws, rules, and regulations, obtain legal counsel, and establish, exercise, or defend our legal rights;

• Protect the safety, rights, property or security of the Services, us, our users, employees, third parties, and the public;

• Prevent fraud and enforce our legal terms and policies; and

• With your consent or at your direction, for any other purpose.‍

We may process your information for the purposes described above, including through the use of automated technology vendors.

Aggregate/De-Identified Information. We may aggregate and/or de-identify any information that we collect so that such information can no longer be linked to you or your device (“De-Identified Information”). We may use De-Identified Information for any purpose, including without limitation for research and marketing purposes, and may also disclose such data to any third parties, including advertisers, partners, and sponsors.

Combined Information. We may combine the information that we collect from any source listed in this Privacy Policy and use such combined information in accordance with this Privacy Policy.

Data Usage for AI and ML Models.  Loxo does not use data obtained through third-party APIs such as Google Workspace APIs or Microsoft APIs to develop, improve, or train generalized AI and/or machine learning (ML) models. Any user data obtained through such APIs is strictly used for the purposes specified in our service offerings and in compliance with applicable privacy laws and regulations.

Legal Bases for Using Your Information. In applicable jurisdictions, we rely on the following legal bases for using your information as set out in this Privacy Policy, as relevant given the type of information and the context and purpose for using it:

• Where we need to perform the contract we are about to enter into or have entered into with you for the Services;

• Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests;

• Where we need to comply with a legal or regulatory obligation; or

• Where we have your consent to process your information in a certain way.


3. How We Disclose Your Information
We may disclose your information to the following categories of recipients:

• Affiliates and subsidiaries. We may disclose the information we collect within the Loxo family of companies.

• Our Customers. We provide information we collect, including combined information, to our Customers as part of the provision of our Services. For example, this includes disclosing Candidate Portal information to Customers, recruiters, or employers when you apply for a role, make your profile visible within the Services, respond to a recruiter communication, express interest in a role, or otherwise direct us to disclose your information.

• Publicly (if you enable your Candidate Portal profile information to be visible). Depending on your profile settings, your Candidate Portal profile information may be viewable to the public.

• Vendors. We may disclose your information to our vendors that perform services on our behalf, which may include billing and payment, sales and marketing, customer relationship management, identity management, automated technology vendors, data storage, web hosting, security, fraud prevention, analytics, lead generation, content, legal, or consulting services.

• Advertising and related analytics partners. We may allow third-party advertising technologies (e.g., ad networks and ad servers) to use cookies and similar technologies on the Services to deliver relevant and targeted content and advertising to you on other websites you visit and applications you use, as explained further in “Online Analytics and Advertising” below.

• Purchasers and third parties in connection with a business transaction. We may disclose your information to third parties in connection with a transaction, such as a merger, sale of assets or shares, reorganization, financing, change of control or acquisition of all or a portion of our business, including for the purpose of diligence or determining whether to proceed or continue with such transaction or business relationship.

• Law enforcement, regulators, and other parties for legal reasons. We may disclose your information to third parties as required by law or if we believe in good faith that such action is necessary to (a) comply with the law and the reasonable requests of regulators or law enforcement; (b) enforce our agreements, including terms applicable to the Services, or to protect the security or integrity of the Services; and/or (c) exercise or protect the rights, property, or personal safety of Loxo, our agents and affiliates, our customers, or others.

• Otherwise with your consent or at your direction. In addition to the disclosures described in this Privacy Policy, we may disclose your information to third parties whenever you consent to or direct such disclosures (subject to any restrictions in our agreements with our customers).

4. Online Analytics and Advertising

Online Analytics.
We may use third-party web analytics services (such as those of Google Analytics) on our Services to collect and analyze usage information through cookies and similar tools; engage in auditing, research, or reporting; assist with fraud prevention; and provide certain features to you. We also use Google Analytics for certain purposes related to advertising, as described in the following section.  To prevent Google Analytics from using your information for analytics, you may install the Google Analytics Opt-out Browser Add-on by clicking here. If you receive email from us, we may use certain analytics tools, such as clear GIFs, to capture data, such as when you open the email or click on any links or banners in the email. This data allows us to gauge the effectiveness of our communications and marketing campaigns.

Tailored Online Advertising. We allow select third party advertising technology partners to place cookies or other tracking technologies on the browser of your device to collect information about you through our Services, as discussed above. These third parties (e.g., ad networks and ad servers such as Google) may use this information to serve relevant content and advertising to you as you browse the Internet, and may access their own cookies or other tracking technologies on your browser to assist in this activity.

We are not responsible for any choices you make using these mechanisms or the continued availability or accuracy of these mechanisms. Please note that if you use these mechanisms, you may still see advertising about our Services across the Internet, but it may not be tailored to you based on your online behavior over time.  If your browsers are configured to reject cookies when you visit this opt-out page, or you subsequently erase your cookies, use a different computer or change web browsers, your NAI or DAA opt-out may no longer be effective. 5. Security & Retention
Loxo takes information security seriously, and maintains a variety of administrative, technical, and physical safeguards that are designed to protect the privacy and security of your information. However, no online system or operations are without risk, and therefore we cannot guarantee that the information and data within our control is absolutely secure. You play an important role in protecting your information, including by maintaining current computer security protections and ensuring the security of your account passwords and other authentication mechanisms.

The information we collect about you will be retained until we determine it is no longer necessary to satisfy the purposes for which it was collected and our legal obligations. In determining how long to retain information, we consider the amount, nature and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of the personal information, the purposes for which we process the personal information and whether we can achieve those purposes in other ways, the applicable legal requirements, and our legitimate interests.

6. International Data Transfers
Loxo is based in the United States. Accordingly, your information may be collected, transferred to, stored and otherwise processed in the United States and any country where we have facilities or in which we engage service providers.  By using the Services you consent to the transfer of information to countries outside of your country of residence, including the United States, which may have data protection rules that may not provide the same level of protection as those of your country, and where that information may be accessible to law enforcement and national security authorities under certain circumstances.

Where required, we will use appropriate safeguards, including Standard Contractual Clauses, when transferring your data outside of the EU.  For more information about these transfer mechanisms, please contact us as detailed in the “Contact Information” section below.

7. Your Rights and Choices
Account Information.  You may make certain changes to your information, such as changing billing information or updating information contained in your Candidate Portal profile, by logging into your account. If you register for an account in the Candidate Portal, you may also be able to manage profile visibility settings, job alerts, recruiter communications, and other preferences through your account settings.

Loxo Professional Profile.  You can opt-out of our database in your Loxo Professional Profile settings from our Privacy Rights & Opt-Out form.

You can also edit or update information about you (including your contact information or employment information) and consolidate multiple profiles into a single Loxo Professional Profile for accessibility or ease of use.

Marketing Communications. In accordance with applicable law, we may send you marketing communications regarding our Services or the services of third parties that we believe will be of interest to you. You may use the unsubscribe link found at the bottom of emails we send to you to opt out of receiving future marketing emails. Please note that, regardless of your request, we may still use and disclose certain information as permitted by this Privacy Policy or as required by applicable law. For example, you may not opt out of certain administrative or transactional emails from us, such as those confirming your requests or providing you with updates regarding this Policy or our other terms.

Rights Regarding Your Information. Depending on your jurisdiction of residence (including the EU, UK, California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia and other U.S. states with similar privacy laws), you may have the right, in accordance with applicable data protection laws, to make requests related to your “personal information” or “personal data” (as such terms are defined under applicable law, and collectively referred to in this section as “personal information”). These rights differ by jurisdiction and by your relationship with us. Specifically, you may have the right to ask us to:

• Inform you about the categories of personal information we collect or disclose about you; the categories of sources of such information; the business or commercial purpose for collecting your personal information; and the categories of third parties to which we disclose personal information;

• Confirm that we are processing your personal information;

• Provide you with access to and/or a copy of personal information we hold about you in a readily usable format (where technically feasible and legally required);

• Correct or update personal information we hold about you;

• Delete personal information we have about you;

• Restrict or object to certain uses of your information; and

• Revoke your consent to the processing of your personal information.

You also have the right to not be discriminated against for exercising your rights.

Minnesota, Delaware, Connecticut, and Oregon residents can request a list of the specific “third parties” (as that term is defined under applicable law) to which we have disclosed personal information, and Maryland residents can request a list of the categories of such “third parties.”

Please note that certain information may be exempt from such requests under applicable law. For example, we need certain information in order to provide the Services to you or comply with applicable law or cooperate with law enforcement requests or investigations. We may also withhold information to the extent that it is a trade secret protected from disclosure under applicable law.

We may take reasonable steps to verify your identity before responding to a request, which may include, at a minimum, depending on the sensitivity of the information you are requesting and the type of request you are making, verifying your name and email address, or your IMEI or other device ID. If we are unable to verify your identity, we may be unable to respond to your requests.

To exercise any of these rights, you can use this form. You may designate an authorized agent to make the requests listed above on your behalf. Depending on the request made on your behalf, in order for an authorized agent to be verified, you must provide the authorized agent with signed, written permission to make such requests or a power of attorney. We may also follow up with you to verify your identity before processing the authorized agent’s request as permitted by applicable law.

If we deny your information request, you may have the right to appeal our decision to deny your request. We will provide information about how to exercise that right in our response denying the request. You also have the right to lodge a complaint with a supervisory authority.

Notice of Right to Opt Out of Sales of Personal Information and Processing/Sharing of Personal Information for Targeted Advertising Purposes. If you are a resident of one of the U.S. states listed in the previous section, you or your authorized agent may also have the right to opt out of “sales” and “sharing” of your personal information, as well as use of your personal information for “targeted advertising” (as those terms are defined in applicable law).

Cookie-based opt-out. As explained in the “How We Disclose Your Information” and “Online Analytics and Advertising” sections above, we may provide personal information (including device and network identifiers and browsing history) to third-party advertising providers for targeted advertising purposes or use related analytics partners to assist us in analyzing use of our Services. Under applicable law, the disclosure of your personal information to these third parties for these purposes may be considered a “sale” or “share” or a disclosure of personal information for targeted advertising.

If you would like to opt out of such disclosures through cookies and similar tools, please click the “Your Privacy Choices” link on our website footer.  To submit a request to opt out of our disclosure of information other than through cookies and similar technologies that are subject to applicable opt out rights, you can use this form. Note that you will need to opt out on each browser and device you use to access the Services and if you use a cookie blocker such as Ghostery, it may block visibility of the link or impede functionality of the link. You must also renew this choice if you clear your cookies or your browser is set to do that.  If you have a legally-recognized browser-based opt out mechanism installed on your device (e.g., Global Privacy Control), we recognize those signals in accordance with applicable law.

Opt out of sales/sharing of personal information to Customers. As described above, we may also make information we obtain from third parties and/or combined information (which may include name, email, phone number, address, approximate date of birth, educational and employment information, information you include in social media profiles (including picture, and any other information that you include in such profile)), available to our Customers as part of the Services. You may send us a request to opt out of our disclosure of your information for these purposes via this form.

Please note that we require authorized agents to provide proof of authorization from the consumer to make an opt-out request on behalf of a consumer.

Opt out of use of sensitive personal information.  We may collect certain categories of information about you that are considered sensitive personal information (as defined in applicable law), including demographic information or Equal Employment Opportunity related information such as race & ethnicity, gender, and disability. Some jurisdictions (such as California) provide you the right to limit or opt out of our processing of this information. However, we only use or disclose this information for business purposes for which you cannot opt out.

8. Notice to California Residents
If you are a California resident, California law requires us to provide you with some additional information regarding how we collect, use, and disclose your “personal information” (as defined in the California Consumer Privacy Act (“CCPA”)).  Please note that under the CCPA, certain types of publicly available information are not considered personal information.

Throughout this Privacy Policy, we discuss in detail the specific categories of personal information we collect from and about you. Opt Out of Sale/Sharing of Personal Information. The CCPA sets forth certain obligations for businesses that “sell” personal information or “share” personal information for cross-context behavioral advertising purposes (as such terms are defined in the CCPA).

For information on how we “sell” or “share” your personal information, please see the “Your Rights and Choices” section above.  If you would like to opt out of our use of your personal information through cookies and similar technologies for “sales” or “sharing,” please click the “Your Privacy Choices” link on our website footer. You must make this choice on each browser/device you use to access the Services.

You must also renew this choice if you clear your cookies or your browser is set to do that. If you have a legally recognized opt out preference signal turned on via your device browser, such as Global Privacy Control, we recognize the preference expressed by such signal for that browser in accordance with applicable law.  

You may send us a request to opt out of our disclosure of your information other than through cookies and similar technologies that are subject to applicable opt out rights, such as to Customers, for purposes that are considered a “sale” or “sharing” under the CCPA via this form.

We do not knowingly sell the personal information of minors under 16 years of age without legally required affirmative authorization.

Right to Limit Use of Sensitive Personal Information. We may collect certain categories of information about you that are considered “sensitive personal information” under the CCPA, such as race, ethnicity, gender or other sensitive information that you may provide including in a social media profile. California law provides the right to limit the use or disclosure of this information if it is used for certain purposes.  However, we only use or disclose this information for business purposes for which you cannot opt out.

Additional California Privacy Rights. California residents may make certain requests about their personal information under the CCPA as set forth in the “Your Rights and Choices” section above.

If we ever offer any financial incentives in exchange for your personal information, we will provide you with appropriate information about such incentives.

Shine the Light. The California “Shine the Light” law gives residents of California the right under certain circumstances to request, on a yearly basis, information about our disclosure of certain categories of “personal information” (as defined in the Shine the Light law) to third parties for their own “direct marketing purposes” (as defined in the Shine the Light law), or in the alternative, that we maintain a policy of providing a cost-free means for consumers to opt out of any such disclosure. You can opt out of these disclosures by emailing us at legal@loxo.co with the subject line “Shine the Light Request”.  If you want to opt out of activities that are considered “sales” or “sharing” under the California CCPA, please follow the instructions above.

Do Not Track. California law requires us to let you know how we respond to web browser Do Not Track (DNT) signals. Because there currently isn’t an industry or legal standard for recognizing or honoring DNT signals, we don’t respond to them at this time. Please note that Do Not Track is a different mechanism than the legally recognized browser-based opt out preference signal mentioned above.

9. Notice to Nevada Residents

If you would like to request that we refrain from selling your Covered Information (as defined under Nevada law), please use this form.

To exercise your rights, please contact us in accordance with the "Contacting Us" section below. We try to respond to all legitimate requests within one month and will contact you if we need additional information from you in order to honor your request. Occasionally it may take us longer than one month, taking into account the complexity and number of requests we receive. If you are an employee of a Loxo customer, we recommend you contact your company's system administrator for assistance in correcting or updating your information.


10. Third-Party Links 
The Services may include links to third-party websites, plug-ins and applications. Clicking on those links or interacting with such content may allow your data to be shared with the relevant third-party. We do not control these third-party websites and are not responsible for the content or practices of these sites or of their privacy statements; we therefore recommend that you read the privacy notice of every website you visit.


11. Children
Our Services are intended for general audiences and are not directed at children. If we become aware that we have collected data without legally valid parental consent from children under an age where such consent is required, we will take reasonable steps to delete it as soon as possible.

If we do so, we will post an updated version of this Privacy Policy, and will provide you with additional notice of any material changes as required by law. We use a third party survey tool to invite a percentage of visitors to provide their feedback. Cookies are used to prevent visitors from being invited multiple times. The second cookie (2) is set if the visitor is invited to participate in the survey, and is used to ensure the visitor is not invited again to participate for a period of 90 days.
